How can you sue a reckless driver?

On Behalf of | Jul 11, 2023 | Personal Injury

North Carolina roads and highways are far safer when drivers obey the laws. Unfortunately, all too many drivers are guilty of numerous violations on a daily basis. As a result, the number of injuries and fatalities on roads in this state is set to reach a historic high.

What kind of damage can recklessness cause?

Motor vehicle accidents can occur at any time of the day or night. For this reason, you need to be prepared. The amount of harm that a reckless driver can cause goes far beyond the damage that they can do to private and public property. You have the right to file a claim for compensation for any damages you suffered.

The claim that you file can reflect the medical expenses that you may have incurred. These would be charges related to the treatment you received for your injuries. This may include emergency room care and long-term hospitalization. You may also need to be compensated for the cost of therapy, rehab, doctor visits and medications.

There are also several non-medical expenses that you are entitled to claim compensation for. These can include the repair costs for any personal property that a reckless driver may have damaged. You may also need to file for compensation to cover costs related to transportation or the care of your children.

Liability for the accident must be proven

Car accidents don’t happen by themselves. There is always a party, or parties, responsible for the incident. To file a compensation claim, you must prove that the other driver was the culprit.

Document any injuries that you may have received. Get medical attention immediately so that these injuries can be documented. You should also collect statements from eyewitnesses, police, and emergency medical personnel. Take as many pictures or videos of the scene as possible. All of this will be evidence that will be required when you file your claim.
